1. Scope

These terms apply to the use of the FIDA Player app (TV and phone version) and this website. The provider is the operator named in the legal notice. When you first start the app you are asked to accept the terms of use; without your consent the app closes. The app shows you the short version (section 2); the full terms are here. The app stores the fact that you have accepted only on your device (see the privacy policy).

2. The key points in brief

  • This app is a pure media player for M3U playlists.
  • It contains no streams and no playlists and does not promote any content.
  • Users are themselves responsible for using only legal sources that are their own or expressly licensed.
  • Using this app to infringe copyright is not permitted.

3. No content, no playlists

FIDA Player is a playback program. Neither the app nor this website nor our servers contain, host, broker, sell or promote TV channels, films, series, playlists or access credentials. We do not name any playlist providers and do not recommend any.

You enter the playlist yourself. It is stored only on your device and is not transmitted to us. We do not know the content of your playlists and do not check it. Example addresses in our guides (for example example.com) are placeholders and lead to no content. Posters, descriptions and trailers for movies and series come, where available, from your provider’s server or from YouTube (see the privacy policy).

4. Your responsibility

You may use FIDA Player only with sources that you are lawfully entitled to use – with your own content or with content that is expressly licensed to you (for example through the subscription of your TV or internet provider). You alone are responsible for ensuring that retrieving and playing the streams you add is lawful and does not infringe the rights of third parties.

Not permitted in particular:

  • using the app to infringe copyright, for example to play unlicensed content;
  • using the app to reproduce content without authorisation or to make it publicly available;
  • circumventing technical protection measures;
  • tampering with the activation check (unless the law allows otherwise).

Protection of minors: Content you retrieve through your provider may be unsuitable for minors. The app can hide categories with typical adult labels (Settings) but does not replace complete youth protection – parents and guardians should supervise use.

5. No decryption of copy protection

The app does not support DRM systems (such as Widevine or PlayReady) and can neither play nor decrypt DRM-protected content. It must also not be used to circumvent copy protection or other technical protection measures.

6. Notices from rights holders

If you are a rights holder and have indications that FIDA Player is being used for infringements, please write to us at firat.oeztuerk@mail.com – stating the work concerned, your rights and a description of the suspected infringement. We review every notice promptly and, as far as possible and reasonable for us, take suitable measures – for example blocking the activation of a device (section 7). Since we do not store or provide any content ourselves, we cannot delete any content.

7. Free of charge, activation and changes

The app is currently provided free of charge. At start-up it asks our server whether the device may use it (details in the privacy policy). We may make the use of the app chargeable in the future; we will announce this in good time in the app and on the home page, and an obligation to pay arises only if you expressly agree to it.

We may block the activation of a device if the app is used abusively, if the activation check is tampered with or if these terms are violated. We may develop, change or – with notice where reasonable – discontinue the app. If we change these terms materially, the app asks for your consent again at the next start.

8. Warranty and liability

The app is provided free of charge. We strive for error-free and uninterrupted use but cannot guarantee it – in particular not for streams from third-party providers whose availability is not in our hands.

We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the Product Liability Act, for fraudulently concealed defects and where we have assumed a guarantee. In the case of slightly negligent breach of essential contractual obligations – obligations whose fulfilment makes proper use of the app possible in the first place and on which you may regularly rely – liability is limited to the foreseeable damage typical for this type of contract. Otherwise liability for slight negligence is excluded. This also applies to our legal representatives and vicarious agents.

We accept no responsibility for content that you retrieve and play with the app or for damage resulting from the use of unlawful sources; that responsibility lies with the provider of the content and with you.

9. External links and trademarks

This website and the app sometimes link to third-party pages (for example the Downloader app or Google’s privacy information). We have no influence over their content and do not adopt it as our own; the respective operator is responsible. No legal violations were apparent when the links were set. If we become aware of any, we will remove the link immediately.

Fire TV is a trademark of Amazon.com, Inc. or its affiliates. Android, Android TV, Google TV, Chromecast, Google Play and YouTube are trademarks of Google LLC. VLC is a trademark of VideoLAN. All other product and company names mentioned (for example NVIDIA, Xiaomi, Sony, Philips, TCL, Hisense, AFTVnews) are trademarks of their respective owners. They are mentioned only to describe on which devices and with which technologies the app runs. FIDA Player is not affiliated with these companies and is neither supported nor endorsed by them.

10. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the country in which you have your habitual residence remain unaffected. If individual provisions are invalid, the rest remains valid; the statutory provision applies in place of the invalid one. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

The German version is binding; translations are for convenience. We are happy to answer questions about these terms at firat.oeztuerk@mail.com.
